Establishing the Military
Court-Martial Review Panel

WHEREAS members of the Alabama National Guard willingly and selflessly serve at the call of the Governor;

WHEREAS it is vitally important for the State of Alabama to maintain the highest level of professionalism within the Guard’s ranks;

WHEREAS military justice is an important tool for commanders to maintain high professionalism, good order, and discipline; and

WHEREAS creation of a courts-martial appeal process within the Guard would serve the cause of military justice, and ensure due process of law;

NOW, THEREFORE, I, Kay Ivey, Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, and in particular Section 31-2A-66 of the Alabama Code, do hereby establish the Military Court-Martial Review Panel (“the Panel”), effective immediately, and further order as follows:

  1. Purpose. The purpose of the Panel shall be to hear appeals from courts-martial under the Alabama Code of Military Justice.
  2. Composition. The Panel shall consist of five members appointed by the Governor, each of whom shall serve at the pleasure of the Governor.
  3. Administrative support. The Adjutant General shall provide administrative assistance to the Panel in furtherance of its purpose.
